Partly under pressure from the collective action of Take Back Your Privacy, TikTok has had to admit that it currently stores personal data of European users outside the EU. This follows from a recent press release in which TikTok announced that it will build a data centre in Dublin (Ireland) where the personal data of European TikTok users will be stored in the future. 

The fact that TikTok stores users’ personal data outside the EU is problematic. Countries outside the EU do not offer the same level of privacy protection and such transfers are subject to strict requirements, which TikTok does not appear to meet. Take Back Your Privacy has therefore also stated in its writ of summons that TikTok is acting unlawfully by processing the personal data of European TikTok users outside the EU. 

Of course, we will continue to critically monitor what exactly TikTok will do with the personal data and whether this is in line with the European privacy rules and we will continue our proceedings against TikTok.
